How Utah takes it
Utah takes the Tier2 Submit file through its own submission portal, and you need a UtahID login before you can reach it.
Utah charges no filing fee — Utah says so outright: “there are no Tier 2 report filing fees for Utah”.
The file we build is the one this state works from.
The filing is due 1 March each year and covers the calendar year before it. Utah does not pass it on for you — we checked. Filing closes the state’s copy only; your local committee and fire department each need their own from you.
Before you send it — what else Utah asks for
Utah wants the file in the state portal, but that is not the end of it. Your county emergency planning committee may run its own portal on top of the state one, and your fire department needs a copy either way. Utah County, for one, says plainly that a state submission does not cover its own. Ask your county before you call it done. Your report also needs a Utah Tier 2 ID number, in the form UT###### (for example UT001234). Do not leave the account until the last week. Utah’s own guide says that to get “reporting access to the online Tier 2 Submission Portal (link will not work unless you have access), you will need to: Create a UtahID account”. Then you email the full name and address you used to set it up. The portal link simply will not open for you until someone at DEQ grants access. And the report goes to three places every year: the state commission (DERR) or the tribal one, your LEPC or tribal committee, and your local fire department.
Does Utah set its own limits?
We have read Utah's own code and it uses the federal thresholds. That is a checked answer, not an assumption.
Utah adopts the federal EPCRA thresholds by reference rather than setting its own, so the federal 10,000 lb / 500 lb-or-TPQ tests apply unchanged. Utah accepts the EPA Tier2 Submit file (.t2s), which is the file we build.
The words we read
Utah Code § 53-2a-702(6): “Requirements of the federal Emergency Planning and Community Right To Know Act of 1986 pertaining to notification and submission of information are the law of this state, and apply equally to federal agencies, departments, installations, and facilities located in this state, as well as to other facilities that are subject to that act.” (Renumbered and Amended by Chapter 295, 2013 General Session.) Utah Admin. Code R698-5 agrees: it defines a “Tier II chemical inventory report” only as “a report required to be submitted to the LEPC under Section 312 of [EPCRA]”, and sets no threshold of its own.

Where we read this
- EPA, “State Tier II Reporting Requirements and Procedures” — Utah: “use EPA’s Tier 2 Submit software … the UDEQ Tier 2 Submission Portal”.Utah DEQ, EPCRA permit guide, read 2026-09-07: “In order to obtain reporting access to the online Tier 2 Submission Portal (link will not work unless you have access), you will need to: Create a UtahID account. Email the full name and email address that you used to setup that ID.” · “Section 312 requires facilities to submit a Tier 2 inventory form annually by March 1st for hazardous chemicals or extremely hazardous substances,” to the State Emergency Response Commission (DERR) “or Tribal Emergency Response Commission (TERC), Local Emergency Planning Committee (LEPC) or Tribal Emergency Planning Committee (TEPC), and the local fire department annually.” The guide names no state filing fee.Utah County LEPC, Tier II page, read 2026-09-04: “All Tier II submissions must be submitted both to UDEQ through their electronic portal, as well as to Utah County LEPC through a different portal”; “Tier II reports must also be filed with the local Fire Department and Local Emergency Planning Committee.”Utah DEQ, Tier 2 Chemical Inventory Program page (deq.utah.gov), read 2026-10-12 through the Internet Archive snapshot dated 2026-08-13 because the live page refuses our requests with HTTP 403: “A Utah Tier 2 ID Number is required for facilities.” and “The ID follows the format UT###### (e.g., UT001234)”.Checked 2026-09-07
