How Puerto Rico takes it
Puerto Rico wants the Tier2 Submit file delivered physically, not uploaded. The commission’s own notice says to export it as a zip and put it on a disc — “ya sea a un CD o a un floppy disk, preferiblemente en un CD.” The current contact is prserc@drna.pr.gov.
Puerto Rico charges no filing fee — it says so itself: “Puerto Rico does not collect fees for filing Tier2 forms”.
The file we build is the one this state works from.
The filing is due 1 March each year and covers the calendar year before it. Puerto Rico does not pass it on for you — we checked. Filing closes the state’s copy only; your local committee and fire department each need their own from you.
Before you send it — what else Puerto Rico asks for
Puerto Rico is not an upload. The commission asks for the file on a CD (or diskette), with a company cover letter and a label, sent by post. You send it to the commission, your local committee and the fire department separately. Three details from the commission’s own notice change what you send. First, the commission and your local committee get the file digitally and only digitally — “en copia digital SOLAMENTE.” The fire station gets paper instead: “Debe enviar una copia impresa a la Estación de Bomberos más cercana a la instalación.” Second, you do not have to resend every safety data sheet — “sólo debe enviar los MSDS de aquellas sustancias peligrosas que sean nuevas en su inventario,” so only the substances that are new since last year. Third, use a live address. The commission now sits under the Department of Natural and Environmental Resources (DRNA) and answers at prserc@drna.pr.gov. The older jca.pr.gov contacts belong to the Environmental Quality Board it replaced.
Does Puerto Rico set its own limits?
Puerto Rico's own agency says it uses the federal thresholds, and we read that page rather than assuming it. We have not gone behind it to the state code, so we say that too.
Puerto Rico applies the federal thresholds unchanged. The commission asks for a Tier2 Submit file, and the report goes to three places rather than one — the state emergency response commission, your local emergency planning committee, and the fire station.
The words we read
US EPA, “State Tier II Reporting Requirements and Procedures” — Puerto Rico section. EPA’s compilation states the submission route and any state-added fields; it records no state threshold below the federal 10,000 lb / 500 lb-or-TPQ tests. The commission’s own notice on DRNA’s site, read 2026-09-07: it defines the duty by reference to the federal statute — “el inventario de sustancias peligrosas cubiertas bajo la Ley EPCRA” — and gives the filing mechanics rather than any Puerto Rico threshold. The numbers we apply are the federal ones in 40 CFR 370, which we read directly.

Where we read this
- EPA, “State Tier II Reporting Requirements and Procedures” — Puerto Rico section, read 2026-09-06: “Puerto Rico SERC is requesting facilities to use Tier2 Submit and to then submit the electronic file in a 3.5” diskette or CD, with one zip file submission. The diskette or CD should be submitted to the PR SERC address with a company cover letter and label on the diskette or CD.”The commission’s own notice on the DRNA site (drna.pr.gov/otrora-jca), read 2026-09-07 and 2026-09-11: “La fecha límite para el envío del informe sobre el inventario de sustancias peligrosas cubiertas bajo la Ley EPCRA es el 1ro de marzo de cada año. The notice gives prserc@drna.pr.gov as the contact. On which agency: the notice sits on the site of the Department of Natural and Environmental Resources (DRNA), and the page’s own path is “otrora-jca” — “formerly JCA”, the Junta de Calidad Ambiental, which English-language material renders as the Environmental Quality Board. That is why the older jca.pr.gov addresses no longer reach anyone, and why we give prserc@drna.pr.gov instead.Checked 2026-09-11
