How New Mexico takes it

New Mexico wants the Tier2 Submit file emailed as an attachment to HAZMAT@DHSEM.NM.gov, and one submission there covers everyone.

The file we build is the one this state works from.

The filing is due 1 March each year and covers the calendar year before it. New Mexico passes it on for you — one submission covers all three. Worth a call to your county, though: a few run their own list on top.

Before you send it — what else New Mexico asks for

Send the file exactly as we give it to you. New Mexico takes only .t2s and says plainly it will not accept a .zip, a PDF or paper. Our file is a zip container under the hood, which is normal for .t2s — do not rename it or compress it again. If it is too big to email, they will take a cloud link or a USB stick by post; ask them first. New Mexico runs “a single-point submission process,” so you file with the Department of Homeland Security and Emergency Management and that is it. Facilities “are not required to provide the same report to the local emergency planning committee (LEPC) or the local fire department unless those agencies maintain local reporting requirements.” The state also says “We do not require E-Plan submissions.” Use the EPA’s Tier 2 Submit software, which is the file we build. The cost is a per-facility fee that steps up with how many chemicals you report: $25.00 for 1 to 3, $50.00 for 4 to 6, $75.00 for 7 to 9, and on in $25 steps, capped at $250.00 per facility. Government agencies (local, tribal, state and federal) are exempt. Payment is part of the filing: the submittal “is considered complete upon receipt of both the electronic submittal and payment of the correct amount.” Payments are due annually on 1 March.

Does New Mexico set its own limits?

New Mexico's own agency says it uses the federal thresholds, and we read that page rather than assuming it. We have not gone behind it to the state code, so we say that too.

New Mexico applies the federal thresholds unchanged. The sliding fee is in the section above. With several sites you add them up, but one owner or operator never pays more than $250 in total.

The words we read

New Mexico Department of Homeland Security and Emergency Management, Tier 2 page: New Mexico requires facilities to use EPA’s Tier2 Submit and charges a per-facility fee — “FEE SCHEDULE PER FACILITY (MAXIMUM PAYMENT OF $250): 1 to 3 chemicals per facility $25…”, with fees calculated per facility and summed across facilities. The page states the reporting duty in the federal terms of EPCRA and publishes no separate New Mexico threshold.
