Tier II · EPCRA section 312

Do you have to file Tier II this year?

Tell us what you keep on site. We check the EPA rules, show our reasoning, and hand you what your state takes.

Start here

Four questions, about 10 minutes.

Free. No account, no email.

Ten minutes later, you know.

  1. 01

    Tell us what you keep

Address, kind of site, what is there, how much.

  2. 02

    We check every EPA rule

The List of Lists, each threshold, each exemption. We show which ones we used.

  3. 03

You get the answer, and the filing

Whether you file, why, and what your state takes — the Tier II file, or the worksheet where it types.

Want every step before you start? How Tallymark works, step by step.

Store oil or fuel? A second rule applies above 1,320 gallons, if a spill could reach water. Check the spill plan, free.

The filing, laid out

Reading it is free. You pay for the file and the worksheet you hand over.

Notes
  1. 11,850 gal converted at 7.10 lb/gal — the gallons-to-pounds table published with the Vermont Tier II package. 40 CFR 370.43(a) is what lets us convert.
  2. 2Reported as a mixture component — the antifreeze drum is counted by the ethylene glycol share its SDS section 3 gives. 40 CFR 370.14(c).
  3. 3Inside the lead-acid batteries on the forklifts and their spares. Car-type batteries in the package the public buys are left out under EPCRA §311(e)(3); industrial batteries like these are not.
  4. 4Your Tier II threshold is 10,000 lb either way — EPA lists hydrochloric acid as extremely hazardous only in its anhydrous and gas forms, not in solution. We still need the concentration: at 37% or above a separate rule applies, Clean Air Act 112(r), with a 15,000 lb threshold.

That is the top of the sheet. Open it on a laptop to read every line. Example facility. The numbers follow the real EPA rules; the shop is not real.

1 March is not the only date

  • A chemical you have not reported before starts a three-month clock.42 U.S.C. 11021(d)(1)
  • Crossing the threshold for an extremely hazardous substance starts a sixty-day one.42 U.S.C. 11002(c)
  • A spill over its reportable quantity is phoned in immediately.40 CFR 302.6(a) · 355 subpart C

The free answer tells you which of these you are already inside, with each date. The reminders keep count.

Every state files Tier II differently, and the free EPA tool does not tell you which way yours works. We checked.

  • 27need it typed into their own site — we give you the worksheet

For comparison: a consultant charges $1,500–3,000 to answer the same question for a first small filing, and EPA’s own free software builds the file but does not tell you whether you must file.
